Welcome to the website of BoldHER Future Inc. (“BoldHER Future,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of our website, including all related pages, forms, educational resources, event pages, donation tools, and online services that link to these Terms (collectively, the “Site”).

 

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

 

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

 

If you are a parent or legal guardian using the Site on behalf of a child, you agree to these Terms on your own behalf and, to the extent permitted by law, on behalf of the child.

 

2. About the Site

The Site is provided to share information about BoldHER Future’s mission, programs, events, volunteer opportunities, resources, fundraising activities, and ways to contact or support us.

Content on the Site is provided for general informational purposes only. Unless we expressly state otherwise, the Site is not intended to provide legal, medical, counseling, educational placement, financial, or tax advice.

 

3. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information, including information relating to children. By using the Site, you acknowledge that you have reviewed our Privacy Policy.

 

4. Children’s Use of the Site

The Site may be used by, or may be reasonably likely to be accessed by, children under 13 in connection with BoldHER Future’s mission and programs.

 

If a child under 13 provides information through the Site, we may require that the information be submitted by a parent or legal guardian, or we may contact the parent or legal guardian before using the information beyond what is reasonably necessary for the requested activity.

5. Donations and Payments

If the Site allows donations, registrations, sponsorships, or other payments:

  • you authorize us and our service providers to charge the payment method you provide for the amount you approve;

  • you represent that you are authorized to use that payment method;

  • donations are generally nonrefundable except as required by law or as expressly stated by us;

  • recurring donations, if offered, will continue until canceled in accordance with the applicable terms presented at signup; and

  • payment processing may be handled by third-party providers subject to their own terms and privacy practices.

 

We reserve the right to correct errors in descriptions, pricing, or transaction details and to refuse or cancel transactions where appropriate.

 

6. Accounts, Forms, and Submitted Information

Some parts of the Site may allow you to register for events, submit forms, sign up for updates, apply to volunteer, make donations, or otherwise provide information to us.

 

You agree that any information you provide will be accurate, current, and complete. You may not impersonate another person or provide false or misleading information.

 

We may suspend or reject submissions, registrations, or accounts if we reasonably believe they violate these Terms or create risk for the Site, BoldHER Future, or others.

 

7. Acceptable Use

You agree not to:

  • use the Site in violation of any applicable law or regulation;

  • submit false, misleading, or fraudulent information;

  • impersonate any person or entity;

  • upload or transmit malware, malicious code, or harmful material;

  • interfere with the operation, security, or integrity of the Site;

  • attempt to gain unauthorized access to the Site, accounts, or related systems;

  • scrape, harvest, copy, or use automated means to collect Site content or personal information without our prior written consent;

  • use the Site to harass, threaten, exploit, abuse, or endanger any person, including any child;

  • post or transmit unlawful, defamatory, obscene, infringing, or otherwise objectionable content; or

  • use the Site for unauthorized commercial solicitation or spam.

 

8. User Content and Submissions

If you submit comments, stories, applications, photos, videos, forms, testimonials, or other materials to us through the Site (“Submissions”), you grant BoldHER Future a nonexclusive, worldwide, royalty-free license to use, host, store, reproduce, adapt, publish, and display those Submissions for our nonprofit, administrative, programmatic, archival, and promotional purposes, subject to our Privacy Policy and any separate consent, release, or media authorization you provide.

 

You represent that:

  • you own or control the rights necessary to submit the materials;

  • the materials do not violate any law or third-party right; and

  • the materials are accurate to the best of your knowledge.

 

We may remove, decline to use, or delete Submissions at our discretion.

 

9. Intellectual Property

The Site and its content, including text, graphics, logos, designs, images, videos, downloadable materials, and software, are owned by or licensed to BoldHER Future and are protected by applicable intellectual property laws.

 

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, educational, informational, charitable, or other noncommercial purposes related to interacting with BoldHER Future.

 

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or exploit Site content except with our prior written permission or as otherwise permitted by law.

 

10. Third-Party Links and Services

The Site may contain links to third-party websites or services, including donation processors, event platforms, social media services, video hosts, or other vendors. We do not control and are not responsible for those third-party services, their content, or their privacy and data practices.

Your use of third-party services is governed by their own terms and policies.

 

11. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLDHER FUTURE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

 

We do not warrant that the Site will be uninterrupted, secure, error-free, or free from viruses or other harmful components, or that Site content will always be accurate, complete, or current.

 

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLDHER FUTURE INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF BOLDHER FUTURE INC. AND ITS RELATED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.

 

Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

 

13. Indemnification

You agree to defend, indemnify, and hold harmless BoldHER Future Inc. and its directors, officers, employees, volunteers, agents, affiliates, and service providers from and against claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the Site;

  • your violation of these Terms;

  • your violation of applicable law or third-party rights; or

  • your Submissions.

14. Accessibility

BoldHER Future aims to make the Site reasonably accessible. If you encounter accessibility barriers, contact us at boldher.future@gmail.com so we can try to provide assistance through an alternative method.

 

15. Security

We use measures designed to help protect information collected through the Site. No system can be guaranteed to be fully secure, and you use the Site at your own risk. You are responsible for using secure devices, networks, and practices when accessing the Site.

 

16. Suspension and Termination

We may suspend or terminate access to all or part of the Site at any time, with or without notice, if we believe you have violated these Terms, created risk for the Site or others, or engaged in unlawful or abusive conduct.

 

17. Governing Law and Venue

These Terms are governed by the laws of the State of Maryland, without regard to conflict of laws rules, except to the extent federal law applies.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Maryland, and each party consents to that jurisdiction and venue.

 

18. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on the Site with an updated “Last Updated” date. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the revised Terms.
